He listened to no advice, avoided public ceremonies, and was half inclined to the life of a solitary. He consciously chose mixed marriages as his battle-ground. He knew that Gregory XVI would back him in disobedience to the rules of the Prussian government. 19 Prussian officials tried to persuade Droste zu Vischering to conform—in vain. A decree ordered that he perform no duties of his office—in vain. On 20 November 1837 police arrested the Archbishop and confined him in the fortress at Minden.

The Catholic clergy of that epoch followed this Prussian rule without questioning it. Then in 1803 the Prussian government issued a declaration that all legitimate children should be educated in the religion of their father. The Catholic clergy continued to conform. The rule could still be said to be impartial between the two denominations. Such contradictions between the law of the Church and its administration could only survive while mixed marriages were few. With the mingling of denominations, the number grew.

With the mingling of denominations, the number grew. In 1825 the Prussian government applied the rule of 1803 to the Rhineland. That is, they applied a rule which fitted the old State of Prussia where the Protestant Church was established, to an area with long traditions of Catholic faith and practice and with no tradition of Protestant establishment. The Prussian government welcomed mixed marriages because it welcomed schools mixed in religion, believing that they would prepare the young to live in a unified state.
